  1. Software License Agreement
  2. for Trial Version of CommNet for Windows
  3.  
  4. This Software License Agreement (the "Agreement") is a legal 
  5. Agreement between an individual or entity and Radient Software, Inc. 
  6. ("Radient Software").  The Software application (CommNet for 
  7. Windows) which accompanies this license (the "Software") is 
  8. protected by United States copyright laws and international treaty 
  9. provisions.  By continuing the installation of the Software, by loading 
  10. or running the Software, or by placing or copying the Software onto 
  11. your computer hard drive, you agree to be bound by the terms of this 
  12. Agreement.
  13.  
  14. 1.  Grant of License.  The Software is provided on a trial basis free of 
  15. charge.  This is intended to allow users time to decide whether to 
  16. purchase the software.  The Agreement permits you to use the 
  17. Software, as well as the accompanying "on-line" or electronic 
  18. documentation, on a single computer.  All users are granted a limited 
  19. license to copy and freely distribute the Software only for the purpose 
  20. of allowing others to try it, subject to the restrictions in Section 3 as 
  21. well as the following:

  23. a) The Software must be distributed in absolutely unmodified form 
  24. including ALL program, documentation, and other files;
  25.  
  26. b) The Software may not be sold as a product or part of a product for 
  27. any reason whatsoever without a license from Radient Software.  
  28. This explicitly includes, but is not limited to, published books, 
  29. catalog vendors, mail order vendors, shareware vendors, retail 
  30. vendors, cover disks, modem manufacturers, and computer 
  31. dealers, including the Software pre-bundled on computers they 
  32. sell; and
  33.  
  34. c) No charges or payment may be levied or accepted for the 
  35. Software.

  37. Bulletin board system operators, online services, FTP sites, and 
  38. computer user groups may post and distribute the trial version of
  39. the Software without written permission only if the above conditions
  40. are met.

  42. 2.  Copyright.  The Software (including any images, video, audio, and 
  43. text incorporated into the Software) and related documentation are 
  44. copyright and are exclusively owned by Radient Software.  You may 
  45. not use, copy, modify, or transfer the programs, documentation, or any 
  46. copy of the Software except as expressly provided by this Agreement.  
  47. The Software is protected by United States copyright laws and 
  48. international treaty provisions.
  49.  
  50. 3.  Other Restrictions.  You may not rent or lease the Software; 
  51. reverse engineer, decompile, disassemble, modify or translate the 
  52. Software or documentation; sell or distribute the Software for money 
  53. or other considerations; or in any manner or through any medium 
  54. whatsoever commercially exploit the Software or use the Software for 
  55. any commercial purpose.

  57. 4.  Warranty and Disclaimers.  This Software is provided on an "as-
  58. is" basis, without representation or warranty of any kind, either 
  59. express or implied.  In no event shall Radient Software or its 
  60. employees be liable for any damages whatsoever, whether direct, 
  61. indirect, special, incidental, or consequential (including, without 
  62. limitation, damages for loss of business profits, business interruption, 
  63. loss of business information, or any other pecuniary loss) arising out of 
  64. the use or inablity to use the Software, even if Radient Software has 
  65. been advised of the possibility of such damages.

  67. This Software and related documentation is in no way connected with 
  68. Comm-Net Information Service, Inc. of Baltimore, Maryland, or any 
  69. other organization, product, or service other than Radient Software of 
  70. Cupertino, California.
  71.  
  72. 5.  U.S. Government Restricted Rights.  Use, duplication or 
  73. disclosure by the Government is subject to restrictions set forth in 
  74. subparagraph (a) through (d) of the Commercial Computer Restricted 
  75. Rights clause at FAR 52.227-19 when applicable, or subparagraph (c) 
  76. (1) (ii) of the Rights in Technical Data and Computer Software clause 
  77. at DFARS 252.227-7013, and in similar clauses in the NASA FAR 
  78. Supplement.  Manufacturer is Radient Software/P.O. Box 
  79. 61776/Sunnyvale, CA 94088-1776.
